DATED : 9th JULY 2021 P.C:- This is a befitting case where custodial interrogation is very much warranted, as can be discerned from the FIR which came to be lodged by the Head Officer of the Bandhan Bank, who allege that when the surprise audit of the Branch was carried out in the office of the Bandhan Bank near Karmala, certain irregularities were noticed. The Branch Manager was one Shri Mundhe and on the date of inspection, there was no co-operation from him and he left the Bank. When the statement was drawn, it revealed that on 12th February 2021, there were 7 transactions of Rs.30 lakhs each, i.e. total amount of Rs.2,10,00,000/- (Two crore ten lakhs). The mirror account reflected that 7 transactions took place through cheques but no such cheques were found in Tilak

On further search, an amount of Rs.1,20,00,000/- (One Crore twenty lakhs) was seen to have been transferred in the account of one Mahavir Logistics, the present applicant - resident of Pothare, District Karmala, and other amounts were transferred into the accounts of different persons. When specifically asked as to how such a huge amount came into his account, learned counsel for the applicant state that it was on account of transfer from Shri Mundhe, but the applicant is not able to offer any plausible explanation about receipt of the said amount. If Mr.Mundhe has parked his amount in the account of the applicant, he is equally answerable to the Investigating Agency when the complaint is lodged alleging misappropriation. The custodial interrogation of the applicant would only provide the necessary answers.

Application is rejected.
