On the last occasion, learned Counsel appearing for the Respondent had raised a preliminary objection as regards the maintainability in view of the deletion of Section 72 of the Maharashtra Public Trusts Act. Faced with this situation, learned Counsel appearing for the Appellant, on instructions, seeks permission to withdraw First Appeal with liberty to file appropriate Petition. First Appeal is permitted to be withdrawn with liberty as prayed. 2.

In view of the disposal of First Appeal, nothing survives for consideration in the pending civil/interim applications and the same stand disposed of.
