At the outset, learned Counsel for Respondent Nos.7 and 14 tendered copy of the Order dated 20th September, 2024 passed by the learned Civil Judge, Senior Division, Karad below Exhibit-1 in Special Civil Suit No.32 of 2015. The same is taken on record. The said Order is reproduced hereinbelow for the sake of brevity :- " In view of withdrawal pursis below Exh.524 by the directors of plaintiff company for withdrawal of the suit, pursis below Exh.528 filed by the defendant No.12 and 1/2

P.H. Jayani 204 AO411.2017 with AO410.2017.doc withdrawal pursis filed by defendant No.11 at Exh.529 for the withdrawal of counter claim I proceed to pass following order :-

ORDER

1.

The suit is disposed of as per withdrawal pursis below Exh.524 vide Order 23 Rule 1 of Code of Civil Procedure, 1908. 2.

The counter claim at Exh.163 is disposed of as per withdrawal pursis below Exh.529 vide Order 23 Rule 1 of Code of Civil Procedure, 1908.

Necessary Court fees be refunded to the plaintiff company and defendant No.11 as per rule.

Proceeding be closed. "

2) From the aforesaid Order, it can be easily gathered that, the said Special Civil Suit No.32 of 2015 and the counter-claim therein have been withdrawn.

3) As a result, both the aforesaid Appeal from Orders stands disposed of, accordingly.

4) Civil Application Nos.532 of 2017 and 533 of 2017 does not survive and stand disposed of.
