It is submitted that the petitioner has made some representation to respondent No.2­ council for payment of family pension. Learned counsel for the petitioner submitted that the petitioner's deceased husband had approached to Maharashtra Administrative Tribunal against the order of the disciplinary authority by filing original application. The said original application came to be dismissed. The petitioner has annexed copy of the judgment passed by the Chief Judicial Magistrate, Solapur in Criminal Case No.1098/2004 filed against the husband of the petitioner for the offences punishable under sections 467, 468, 471, 477(A), 420 and 403 read with section 34 of Indian Penal

skn 2/2 6822.14­wp.sxw Code. It is submitted that the said case was abated against the petitioner's husband as he expired.

As the petitioner has already made representation to respondent No.2­ council, the council will look into the matter and take appropriate decision in accordance with law. We have not expressed any opinion on the merits of the representation.

Writ petition is disposed of accordingly.
