The petitioner-original plaintiff is challenging the judgment and orders passed by the Courts below rejecting temporary injunction application filed by the petitioner. Since at least 13 October 2016, there is no injunction running in favour of the petitioner. Hence, no interference in the impugned orders is called for. However, all questions raised by the petitioner on merits of the matter are kept open to be agitated before the Trial Court at the time of hearing of the suit. The writ petition is dismissed. 2.

The Trial Court shall decide the suit uninfluenced by the observations made by the Courts below in the impugned orders. 3.

Pending interlocutory application(s), if any, stand disposed of.
