The proposal seeking approval to the appointment of the petitioner as Laboratory Assistant has not been granted on the ground that the post of Laboratory Assistant is not sanctioned.

The affdavit is fled by the State. Along with the affdavit, a document is placed on record to submit that on 22nd June 2022 the decision has been taken to sanction one post of Laboratory Assistant in Respondent No.4 School. 3.

In light of that there would be no impediment for the Deputy Director of Education to consider the proposal of the petitioner for grant of approval to his appointment as Laboratory Assistant.

In light of above, we pass the following order :

ORDER

i) The Deputy Director of Education shall reconsider the proposal seeking approval to the appointment of the petitioner as 'Laboratory Assistant' in view of subsequent order passed sanctioning one post of 'Laboratory Assistant' in respondent No.4 School under order dated 22nd June 2022.

ii) The decision shall be taken preferably within four months.

iii) Depending upon the decision taken by the Deputy Director of Education on the proposal of the petitioner, the further process and decision be taken with regard to the Shalarth ID.

iv) The writ petition is disposed of. No costs.
