The Applicant apprehends his arrest in C.R. No. 239 of 2023 registered with Fouzdar Chawdi Police Station, Solapur, for the offences punishable under Sections 354, 354-D, 506 and 507 r/w 34 of the IPC and Section 12 of the Protection of Children From Sexual Offences Act, 2012.

Heard Mr. Ritesh Thobde, learned counsel for the Applicant, Mr. S.H. Yadav, learned APP for the Respondent-State and Ms Snehal Kolamkar, learned counsel for Respondent No.2. I have perused the records and considered the submissions advanced by the 1/3
learned counsel for the respective parties.

The aforesaid crime was registered pursuant to the FIR lodged by the mother of the victim. A perusal of the FIR prima facie reveals that the Applicant was continuously stalking the minor daughter of the First Informant, who is barely 13 years of age. It is also stated that the Applicant has sent her whatsapp messages. 4.
The Applicant is a young boy of 21 years of age. By order dated 14/06/2023 this Court had granted interim protection to the Applicant considering his age and the fact that he was a student of 12th standard. It is stated that he is likely to take admission at Pune for B.Pham. and he has shifted to Pune. Learned APP states that pursuant to the said order, the Applicant appeared before the Investigating Officer and that he has been interrogated.

Learned counsel for the Applicant, under instructions states that the Applicant will not enter jurisdiction of Fouzdar Chawdi Police Station, Solapur, unless required by the Investigating Officer and that he shall not in any manner interfere with the Victim-girl or her family. 2/3

In the light of the said statement and considering the above facts and circumstances, interim relief granted by order dated 14/06/2023 stands confirmed. The Applicant shall report to the Investigating Officer as and when required by the Investigating Officer for the purpose of investigation.

The application stands disposed of.
