All the learned counsel submits that by these two petitions, petitioners are challenging the same order passed by Family Court at Kolhapur. He further submitted that Petitioner in Writ Petition No. 761 of 2023, challenging the maintenance 1/2

40-WP-761-2023.doc amount of Rs.50,000/- directing him to pay to the Respondents. Whereas, in Writ Petition No. 2615 of 2023, the Petitioner challenging the maintenance amount of Rs.50,000/- awarded to him for enhancement.

Both the learned counsel submitted that the maintenance application filed before the trial Court is in final stage. Hence, these petitions can be disposed of by giving opportunity to both sides to argue before the trial Court in respect of their contentions.

Considering the submissions of both the learned counsel, I pass following order :

O R D E R

I.

Writ Petitions are disposed off .

II.

Both parties can put their sides before the trial Court in respect of their contentions.

III. Contentions of both the parties are kept open. IV. The learned Family Court, Kolhapur is requested to dispose of the pending application as early as possible preferably within a period of 6 months from the receipt of this order.
