We have heard learned counsel for the Petitioner and learned AGP for the Respondent-State.

It is submitted by the learned Advocate for the Petitioner that the Petitioner was paying royalty every year. The Petitioner was only concerned with minor minerals and was not engaged in crushing of gravel. According to the learned Advocate, the Petitioner applied for execution of lease agreement to the Collector. The Tahsildar has also forwarded report but the Collector has not taken any action. The report as appears is of 18/06/2021 (page 83).

In case the proposal of the Petitioner as recommended by the 1/2

93.aw2357.22.doc Tahsildar (page 83) Exhibit-F is pending with the Collector, Sangli then the Collector, Sangli shall take decision upon it on its own merits in accordance with law expeditiously and preferably within four months. As far as the order of Tahsildar is concerned, the Petitioner has the alternative remedy.

All contentions of the parties are kept open. 5.
