Though twice notice is sent, none appears for respondent no. 2. Service report is not yet received. This application is for condonation of delay. There is a delay of 3 years and 240 days. It is stated in the application that the applicant is in jail. There is no one to give instructions to the lawyer. It is for this reason, the appellant is required to send communication from the jail. For this reason the delay is caused. Heard learned advocate appointed for the accused/appellant, this Court finds that the applicant is in jail and for that reason he could not contact anyone to file application and appeal. 9-ia-2541-2023.doc varsha
He is required to approach this Court through Legal Services Authority. This Court thus finds that delay in such case needs to be condoned in the interest of justice. Hence the following order:
