Heard the learned counsel for the Applicants and the learned APP for the State.

The Applicants herein are charge-sheeted in Crime No. 140 of 2017 for offences punishable under section 307, 143, 147, 148, 149, 326, 323, 504 r/w. 34 of the Indian Penal Code.

The incident had occurred on the eve of the elections of the Gramp Panchayat of Radhanagari. This Court vide order dated 1st of August, 2018 had allowed the application filed by the Applicants under section 439 of Cr.P.C. and they were enlarged on bail upon imposing certain conditions and one of the conditions was that they shall not enter into the gram-panchayat jurisdiction of Radhanagari.

The investigation is completed and the charge-sheet is filed. 5.

The Applicants undertake that in the eventuality the conditions are relaxed, they would not tamper the prosecution witnesses/ evidence and they would attend every stipulated date before the Trial Court. They further undertake that they would not indulge in similar activities in future. 6.

Undertaking is taken on record and marked 'Article X' for the purpose of identification.

The learned counsel for the Applicants also submits that the principal accused Rajendra Bhatale has been enlarged on bail by this Court on 1st August, 2018 and the condition imposed upon him that he shall not reside at Huda, Taluka Radhanagari, District Kolhapur till 15th October, 2018. 2/3

By virtue of doctrine of parity, the conditions are relaxed. The Applicants shall not reside in Tal. Radhanagari till 15th October, 2018. 9.
