Considering the fact that this petition challenges merely part I of the award, namely, an order that the inquiry was fair and proper, which order was passed on 31 March 2012 and confirmed in revision by the Industrial Court on 31 December 2014, the petition is disposed of, by consent of parties, in terms of the following order :
(I) The Labour Court shall proceed with the inquiry under Complaint (ULP) No.39 of 2011, as expeditiously as possible, and in any event, dispose of the same within a period of three months from today. (II) The Petitioner shall be entitled to challenge the final order on the complaint, if it goes against him on the basis of grounds urged in the present petition. All rights and contentions of the parties on the conduct of the inquiry, which is the subject matter of the impugned orders of the Labour Court and Industrial Court, respectively, dated 31 March 2012 and 31 December 2014, are, accordingly, kept open for a future challenge. (III) No order as to costs.
