IN THE HIGH COURT OF JUDICATURE AT BOMBAY

CIVIL APPELLATE JURISDICTION APPEAL FROM ORDER NO.956 OF 2015 ALONG WITH CIVIL APPLICATION NO.1171 OF 2015 Swati Abhay Lele and Anr.

.... Appellants-Applicants V/s.

Rasmi Ramesh Natu .... Respondent Mr. Ashutosh M. Kulkarni, a/w. Mr. Gaurav Sharma, for the AppellantsApplicants. Mr. Suresh M. Sabrad for the Respondent.

CORAM : DR. SHALINI PHANSALKAR-JOSHI, J.

DATE : 21 ST AUGUST, 2018.

P.C. :

1.

Heard Mr. Kulkarni, learned counsel for the Appellants-Applicants, and Mr. Sabrad, learned counsel for the Respondent. 2.

The relief of interim injunction, which was claimed by the Appellants-Applicants, restraining the Respondent from creating third party interest in the suit property, is rejected by the Trial Court and hence, the instant Appeal.

3.

It is pointed out by learned counsel for the Appellants that, the 1/2 AO-956-15.doc

order of interim relief is granted by this Court, when the Appeal was filed in the year 2015 and the said order is still in force. It is further submitted that, now the Suit is ready for final hearing, as the issues are already framed.

4.

In view thereof, learned counsel for the Respondent fairly concedes that, as the order of ad-interim relief granted by this Court is in force since the year 2015 till today, the same order may be continued till the decision of the Suit.

5.

In view thereof, the Appeal, along with Civil Application therein, stands disposed off. The order of ad-interim relief granted by this Court is continued till the decision of the Suit.

6.

Needless to state that, the Trial Court will expedite the hearing of the Suit.
