DATE : 15th JANUARY 2025 P.C.:- 1) Vide letter dated 27th November 2024, the learned Additional Sessions Judge, Sangli (Shri P.B.Jadhav) seeks further extension of one year to dispose of both the Sessions Cases, i.e., Sessions Case No.33 of 2018 and Sessions Case No.20 of 2019 since each case has a bearing on the other.
2) It is not in dispute that Sessions Case No. 33 of 2018 has come to its fag end inasmuch as 313 statements of the accused are recorded. As far as Sessions Case No.20 of 2019 is concerned, the prosecution has filed draft charges in the said case and the case was fixed for framing charges on 30th November 2024. 1/3
3) Admittedly, both the Sessions Cases have been expedited by this Court vide separate orders. The accused are languishing in jail for about five years.
4) Considering the aforesaid, we are not inclined to grant one year's extension. However, we grant extension of six months from today to the learned Additional Sessions Judge to dispose of both the aforesaid Sessions Cases. The learned Judge to take up the cases preferably on day-to-day basis.
5) In the event, there is non-cooperation from the lawyers for the accused, report be submitted to this Court. It is always open for the learned Judge to appoint a legal aid lawyer, in the event, the advocates do not co-operate in the expeditious disposal of the cases. 6) The aforesaid order be sent forthwith to the learned Additional Sessions Judge, Sangli to enable him to proceed with the cases preferably on day-to-day basis and conclude the same expeditiously, within six months from today.
7) Registry to forthwith send this order by fax/e-mail or 2/3
through a Special Messenger, to the concerned Judge seized of both the cases.
