This is an application for condonation of delay of about 669 days in filing the appeal along with leave to file appeal, challenging the judgment and order of acquittal of the respondent in the matter of offence punishable under Sections 380, 454 and 427 of IPC.

It is argued on behalf of the applicant that initially to challenge the order of acquittal, the applicant approached the concerned Sessions Court, but, he could not get any relief and as such after proper legal advice he has approached this Court and filed an application and for this delay of 669 days occurred. 1 / 2

Considering the grounds and considering the circumstances under which the applicant came to this Court, said delay is condoned. Application for condonation of delay is allowed and disposed of accordingly. Registry to register the application for leave to appeal, forthwith.
