This civil application seeks recall of a dismissal order passed on the MCA. The order was passed on account of non-prosecution. The MCA was not served on the Respondent. In the premises, and for the reasons stated in the civil application, the dismissal order dated 3 June 2019, is recalled and set aside and the MCA, being MCA No.99 of 2019, is restored to file. The MCA to appear on board for admission on 3 December 2019. Office to issue notice in the MCA to the Respondent returnable on that date. The Applicant may also serve the Respondent privately and file an affidavit of service by the next date. The civil application is disposed of accordingly.
