The allegation against Petitioner that, he committed an offence as contemplated under Sections 4 & 8 of the Protection of Children from Sexual Offences Act, 2012, has been duly proved before the trial Court. The victim girl was aged about 8 years at the time of commission of offence. The evidence of victim girl has been duly corroborated by other substantive pieces of evidence. In view of the said fact, the learned District Judge - 6 & Additional Sessions Judge, Thane has given adverse opinion for not considering the Application of Petitioner for extending benefit of remission in pursuance of Government Circular dated 03.06.2017 issued on account of 125th Birth Anniversary of Dr. Babasaheb Ambedkar. We see no reason to take a different view than expressed by the learned Judge of the trial Court in his opinion dated 21.03.2022. 3.
Petition is accordingly dismissed.
