After arguing for some time, when I expressed my disinclination to grant relief, learned counsel for the Appellant does not press this Appeal. He seeks liberty to approach the Special Court, for her release on regular bail. He submitted that the Appellant was on interim protection since 18/12/2020 granted by this Court. O R D E R
(i) The Appeal is allowed to be withdrawn.
(ii) If and when the Appellant surrenders or is arrested and if she makes an application for bail with prior notice to the State as well as to the Respondent No.2 herein, the said bail application be decided as far as possible on that day itself, in accordance with law.
(iii) The Court shall not be influenced by withdrawal of this Appeal, while deciding the bail application.
(iv) Interim protection granted by the earlier order dated 18/12/2020 is extended by a further period of three weeks from today.
(v) Appeal stands disposed of accordingly.
