Heard learned Counsel for the parties.

The Petitioner has sought a writ of mandamus to appoint the Petitioner on permanent basis on the post of peon in the office of Social Welfare Department, Kolhpur.

The post sought is a public post to be filled in through public participation. The Petitioner has relied on the communication issued by the office of Assistant Commissioner to Regional Deputy Commissioner stating that the Petitioner has been making inquires regarding his application and the proposal is being forwarded to the Regional Deputy Commissioner, Respondent No. 2. This communication cannot be read akn 1/2

7.WP.3432.2024.doc as a mandate to the Regional Deputy Commissioner, but as forwarding of the proposal.

All that we can say is that the Regional Deputy Commissioner will take a decision thereupon keeping in mind the law regarding public employment as laid in various decisions of this Court and the Hon'ble Supreme Court.
