Heard learned counsel for the applicants. This application is for bringing legal heirs of deceased appellant No.3 Sambhaji Maruti Shinde who died on 6.5.2015. Present civil application is filed on 2.7.2015 i.e. within time.
2) Considering the submissions made by the learned counsel for the applicants and the reasons disclosed in the civil application I satisfied that the applicant has made out a case for following order. Order a) The applicants are permitted to bring the legal heirs on record of deceased Appellant No.3 in Second Appeal No.552 2004 and pending civil application if
any within 8weeks from today failing which second appeal shall stand dismissed without further reference to the court.
b) If amendment is carried out as stated above, the applicant is directed to serve the respondents with amended copy of second appeal memo immediately thereafter.
c) Civil Application stands disposed of accordingly. (K.K.TATED,J.)
