For the reasons recorded separately, following order is passed :­

ORDER

I) The Appeal is partly allowed.

II) The conviction under Section 302 of IPC is altered to one under Part I of Section 304 of IPC.

III) For the said offence, the accused is sentenced to BGP.

(231)­Apeal­802­12.doc. 2 suffer rigorous imprisonment for ten years. Rest of the order with regard to fine etc. is maintained. IV) Needless to state that the Appellant would be entitled to set off for the period, he has already undergone.
