This is an application for modification of the condition imposed by the learned Sessions Judge while granting bail to the applicant vide order dated 23/11/2020 in Criminal Misc. Application No.802/2020. The learned Sessions Judge has directed the applicant to furnish a P.R. Bond in the sum of Rs.2 Lakhs with a solvent surety in the like amount and to deposit cash surety of Rs.2 Lakhs.

According to the learned counsel for the applicant, the conditions are onerous, amounting to denial of bail. Mamta Kale page 1 of 2

The learned APP has left the matter to the discretion of the Court.

After having heard the learned counsel for the parties, I find that it would be appropriate to modify the conditions as underORDER 1.

The applicant shall be released on bail on executing a P.R. Bond in the sum of Rs.50,000/- with one or two solvent sureties in the like amount and on deposit of cash surety of Rs.50,000/-.

The applicant shall furnish his permanent address alongwith proof before the learned Magistrate.

The rest of the conditions remain as they are. 4.

The Criminal Application is disposed off in the aforesaid terms.
