Hence, he seeks leave to withdraw this application with further liberty to approach the sessions court under section 439 of Cr.P.C. in the changed circumstances.
2] It is made clear that this application has not been heard on merits. The learned Sessions Court shall consider the

The said application also be heard on its own merits without being influenced by the withdrawal of this application.
