The learned counsel appearing for the Petitioner Shri C G Gavnekar, considering the challenge raised in the above Petition which is to the rejection of an application for condonation of delay in filing the Appeal, seeks leave to withdraw the above Petition with liberty to file a Second Appeal. The above Writ Petition is accordingly allowed to be withdrawn with liberty to file a Second Appeal. If the issue of limitation arises, the fact that the Petitioner was prosecuting the instant Petition in this Court can be urged by the Petitioner.
