DATE : FEBRUARY 1, 2019 P.C.:­ After arguing the matter for some time, learned counsel for the applicants, on instructions, does press the application for applicant Shivaji Ramchandra Sid. As such, application of Shivaji Ramchandra Sid stands rejected.

So far as the other applicants Sambahaji Ramchandra Charane, Ranjit Sambhaji Charane, Sushant Sambhaji Sid in crime No.164/2018 for offence punishable under sections 307, 452, 427,143, 147, 148, 149, 325, 504 and 506 of the Indian Penal Code and section 7 of the Prevention of Damage to Public Property Act, 1984 registered with Vadgaon police station, Kolhapur a concerned, they are seeking pre­arrest bail. 3.

There are cross complaints on account of political rivalry.

Considered the role attributed against the other applicants in the crime in question. In my opinion, the injured has suffered simple injuries. As such, no custodial interrogation is warranted.

Apart from above, as there are no other criminal antecedents against the applicants. Hence the order:­ I) The application in respect of the applicant Shivaji Ramchandra Sid stands rejected.

ii) In the event of arrest in Crime No.164/2018 for offence punishable under sections 307, 452, 427,143, 147, 148, 149, 325, 504 and 506 of the Indian Penal Code and section 7 of

3 2) aba1210-18.doc the Prevention of Damage to Public Property Act, 1984 registered with Vadgaon police station, Kolhapur, the applicant No.2 Sambahaji Ramchandra Charane, No.3 Ranjit Sambhaji Charane and No.4 Sushant Sambhaji Sid be released on bail on their executing P.R. bonds of Rs..25,000/­ each with one or more sureties each in the like amount;

iii) The applicants shall attend the Investigating officer on as and when directed;

iv) The applicants shall not influence the prosecution witnesses or tamper with the evidence;

v) The applicant shall co­operate with the investigating agency; vi) The application stands disposed of accordingly. vii) In view of the disposal of the Anticipatory Bail Application, the criminal application also stands disposed of. (NITIN W. SAMBRE, J.)
