IN THE HIGH COURT OF JUDICATURE AT BOMBAY

CIVIL APPELLATE JURISDICTION WRIT PETITION NO.3023 OF 2021 Appasaheb Gurusiddhappa Lakshetti and others ... Petitioners

Versus

The State of Maharashtra & Anr.

... Respondents ....

Dr. Ramdas P. Sabban, Advocate a/w. Praveen Sabban for the Petitioners. Mrs. R.M. Shinde, AGP for Respondent No.1-State. ....

CORAM : R. D. DHANUKA AND M. G. SEWLIKAR, JJ.

DATE : 23rd JUNE, 2022 P.C. :

1.

The matter is placed on board, for speaking to the minutes of the order dated 24.2.2022 passed by the Division Bench of this Court, on the praecipe filed by the learned counsel for the Petitioners.

2.

Dr. Sabban, learned counsel for the petitioners invited our attention to the purchase notice issued by the petitioners and PRADIPKUMAR PRAKASHRAO DESHMANE submits that the purchase notice was issued in respect of the land PRADIPKUMAR PRAKASHRAO DESHMANE Date: 2022.06.24 11:05:39 +0530 bearing sub-plot Nos.40 to 45 and 49 to 54. However, in prayer clause (a) of the Petition, the sub-plot numbers are inadvertently 1 / 2 Deshmane(PS)

1-wp-3023-21.odt mentioned as "41 to 45" and consequently while granting the relief to the petitioners by this Court in the order also the same mistake had cropped up.

3.

Perusal of the purchase notice indicates that the purchase notice was given in respect of the land bearing sub-plot Nos.40 to 45 and 49 to 54. We accordingly permit the petitioners to carry out the amendment in the prayer clause (a) of the petition forthwith. Re-verification is dispensed with.

4.

We clarify that in paragraph-14 of the order dated 24.2.2022, the relief is granted in respect of sub-plot Nos.40 to 45 and 49 to 54 instead of sub-plot Nos.41 to 45 and 49 to 54. The order dated 24.2.2022 stands corrected. Accordingly, the praecipe is disposed of.
