02-SA-239-1993.doc The Second Appeal has been pending since 1993. On 19th July, 2023, learned Counsel for the respondent Nos.1 and 3(a) moved an application for fixing the date of hearing on the ground that the parties are senior citizens. At that time Ms. Kambli has given her 'no objection' if the Second Appeal placed for final hearing. Accordingly, Second Appeal was listed for final hearing on the board in the week commencing from 7th August, 2023. It is now almost for one year the matter has not been heard. It seems that the appellant is not interested in prosecuting the Second Appeal and hence, it stands dismissed for want of prosecution.

In view of disposal of Second Appeal, Civil Application, if any, also stands disposed of.
