3) Both the Appellants seek liberty to withdraw their respective Appeals. The Appeals are allowed to be withdrawn in view of the Consent Terms.

4) Award be modified and drawn according to the Consent Terms.

5) In view of the foregoing, the First Appeals stand disposed of as withdrawn in view of Consent Terms.

6) All pending Interim Applications, if any, are disposed of. 7) Court Fee be refunded as per Rules.

8) In First Appeal No.1233 of 2009, the Statutory Deposit shall be transferred to the Tribunal.

9) Record and Proceedings be sent back to the Tribunal forthwith.
