OPERATIVE PART OF THE JUDGMENT :

For the reasons dictated in the open Court, the following is the order passed in these appeals:

(i) The conviction and sentence of the appellant (accused No.9­ Sidharam Shivkaran Mangrule) imposed under the impugned judgment and order dated 7th June 2012 passed by the learned Ad hoc Additional Sessions Judge, Solapur in Sessions Case No.144/2008 is hereby quashed and set aside and the appellant is acquitted from the offences against him;

(ii) The order passed regarding Muddemal articles is confirmed; (iii) The appellant shall be forthwith set at liberty provided he is not required in connection with any other offence; (iv) The appeal is allowed in the above terms; (v) All concerned to act on an authenticated copy of the operative part of the order.
