This application is moved for restoration of Civil Application No.1130 of 2009 and First Appeal No.2441 of 2011 as against the Respondent No.5 and the order dated 27th November, 2012 be recalled. 2.

Mr.Joshi, the learned Counsel for the Applicant submitted that Santosh Chandrakant Karekar is a Respondent No.5 and notices were not served on him. Respondent No.5 was not traceable and, therefore, he prayed to serve Respondent No.5 by publication. He further submitted that Mr.Harshad Bhadbhade is advocate on record for Respondent No.5.

In view of this, Applicant is allowed to serve the Counsel of the Respondent No.5 by hand delivery and so also service of Respondent No.5 by publication in newspaper, as prayed is allowed. 4.

Civil Application is disposed of.
