The State of Maharashtra & Ors.

... Respondents Ms. Rohini Madhav Dandekar for the Petitioner. Mr. D.P. Adsule, A.P.P. for the State.

CORAM : A. V. NIRGUDE, J.

DATE : 16th NOVEMBER, 2015.

P.C. :

This Petition deserves to be dismissed at this stage. Petitioner is the original complainant. He filed complaint against in all 8 persons as accused. The learned Magistrate refused to issue process against accused Nos.5 to 8. On perusal of the impugned order and in juxtaposition of the details mentioned in the complaint, the order does not require interference. The learned Magistrate has used his discretion correctly. The petitionercomplainant should continue his case against whom process is issued already. There is no need to interfere in the impugned order passed by the learned Sessions Judge dismissing the Revision.

Petition is dismissed.
