Mr. Patil, learned Counsel appearing for the Appellant states that the sole Appellant has passed away in the year 2024. He states that legal heirs of the sole Appellant has informed that they are not interested in pursuing the Second Appeal.

Ms. Kurdukar, learned Counsel appearing for the Respondents states that, in fact, the sole Appellant has already alienated her entire right, title and interest in the suit property in favour of third party purchasers.

Accordingly, Second Appeal is dismissed for non-prosecution. 4.
