First Appeal has been preferred challenging the judgment and award passed by the District Court granting custody of children to Respondent. The judgment of the District Court is of the year 1997 and in the First Appeal of the year 1997, the pleading is that the son is about 9 years of age and the daughter has completed 12 years of age. 2.

Learned counsel appearing for Appellant submits that there are no instructions from the Appellant and as such, he is unable to proceed with proceedings. Considering the age of children, it is evident that the children has attained the majority and therefore, the First Appeal itself has been rendered infructuous.

First Appeal is dismissed as infructuous.
