Heard Mr. Bhavake, learned Counsel for the petitioner and Mr. Shalgaonkar, learned A.G.P, for respondent - State. 2.
Learned Counsel for the petitioner submits that proposal dated 29th February, 2024 ("Exhibit G Colly") submitted by respondent No.7 - Head Master, Adarsh Vidya Mandir, Nangole seeking individual approval to the appointment of the petitioner in the post of "Shikshan Sevak" was rejected by respondent No.5 - The Education Officer (Secondary) Zilla Parishad, Sangli SHAILAJA SHRIKANT HALKUDE SHRIKANT HALKUDE Date: 2025.09.24 15:47:37 +0530
39-WP-16477-2024.doc vide an order dated 10th April, 2024 without giving an opportunity to the Management to cure deficiencies mentioned in the impugned order. 3.
In our opinion, respondent No.5 ought to have informed the deficiencies to the Management and an opportunity ought to have been given to the Management to cure the said deficiencies. The order dated 10th April, 2024, therefore, be treated as "Show Cause Notice" to respondents No.6 and 7 - Management. Respondents No.6 and 7 - Management to cure the deficiencies within a period of four weeks from the date of communication of this order. If there are any further deficiencies, respondent No.5 - Education Officer to intimate respondents No.6 and 7 - Management within a period of two weeks thereafter. Reasonable time be granted to respondents No.6 and 7 - Management to cure deficiencies, if any. Show cause notice be decided within a period of twelve weeks from today. In the event, approval is granted by respondent No.5 - Education Officer, Shalarth I.D be issued in favour of the petitioner by respondent No.4 - The Deputy Director of Education expeditiously.
