After arguing at length, learned counsel for the petitioner seeks leave to withdraw both the petitions with liberty to the petitioner to challenge the deemed termination as has been borne by Hemant Vasantrao Nilegaonkar Date:

With the aforesaid liberty, W.P. No.10314 of 2015 is allowed to be withdrawn and is dismissed as such. In case petitioner approaches the College/University Tribunal within one month from today, the petitioner's matter be decided on merits by the Tribunal and shall not be dismissed on the ground of limitation. In so far as grounds raised in WP No. 7131 of 2013, the question in regard to the approval to the petitioner's appointment is kept open. Parties are free to raise all the contentions as may be available before the Tribunal.

With the aforesaid observations and liberty, both the petitions are disposed of.
