Heard learned counsel for the Applicant and learned A.P.P. for some time.

The learned counsel for the Applicant points out that after the learned Sessions Judge has rejected the application for bail filed by the applicant on 17.05.2019, the evidence of the complainant is recorded on 05.02.2020, in which the complainant has resiled from her statement before the police.

26 ba 1809-19= In view of this, the learned Counsel for the applicant seeks leave to withdraw the application with liberty to move the Sessions Judge afresh for bail.

In that view of the matter, the Criminal Application is disposed of as withdrawn with liberty as prayed. 5.

It will be open for the Applicant to move the learned Sessions Judge afresh for bail.

If such an application is filed, the learned Sessions Judge shall decide the same on its own merits and in accordance with law, as expeditiously as possible and within a period of two weeks from the date of its filing.
