1st December 2024 PC:- 1) This Revision Application has been preferred by the Original Accused, who has been convicted by trial Court. By virtue of the order dated 30th September 2003 passed by Judicial Magistrate First Class, Kudal which was confirmed by Additional Sessions Judge, Sindhudurg-Oros by judgment and order dated 8th October 2004, he was directed to pay compensation of 1/3
Rs.1,89,814/- and to undergo simple imprisonment for six months. The Revision Applicant thus, impugned the orders directing him to pay compensation to the Respondents. During pendency of Revision Application, Respondent No.1 died on 23rd March 2023.
2) Applicant and the wife of Respondent No.1 are appearing through Video Conferencing from the District Legal Services Authority ('DLSA'), Sindhudurg. The DLSA, Sindhudurg has verified the identities of the parties.
3) In the meantime, the parties have amicably settled the matter and the wife of Respondent No.1 has received amount of Rs.50,000/- towards compensation through Demand Draft dated 19th November 2024 drawn on Bank of India, Kudal Branch. The Respondent No.1 also states that she has no grievance if the order of conviction is set aside. They have filed Settlement Format dated 19th November 2024 along with copy of Demand Draft. It is signed by the Applicant, wife of Respondent No.1, their respective counsel and Secretary, D.L.S.A., Sindhudurg. It is taken on record and marked 'X' for identification.
4) In view of the foregoing, the Revision Applicant seeks liberty to withdraw the Revision Application. Liberty is granted.
5) Revision Application stands disposed of as withdrawn.

6) The Revision Applicant is hereby acquitted of the offence punishable under Section 138 of the Negotiable Instruments Act, 1881.
