It is the prosecution's case that on 14th February 2025, police arrested accused no. 1 alongwith 2 1⁄2 Kg Ganja. It is alleged that said Ganja was given to accused no. 1 by the applicant. 3.

It is the contention of learned counsel for applicant that accused no. 1 is brother-in-law of the applicant. The dispute is going on between the sister of the applicant and accused no. 1. To take revenge of that dispute, name of the applicant is involved in this case.

Applicant is 19 years old boy, having no antecedents. Hence, requested to allow the application.

It is the contention of learned APP that applicant had kept said Ganja in the house of accused no. 1. There is involvement of the applicant in the said crime. To know the source of Ganja, custodial interrogation of the applicant is required. Hence, requested to reject the application.

I have heard both learned counsel, perused F.I.R. and documents produced on record. It appears from the record that applicant had kept the Ganja in the house of accused no. 1 on 14th January 2025 whereas police had seized it from accused no. 1 on 14th February 2025. The documents produced on record shows that dispute is going on between the applicant's sister and accused no. 1 who are husband and wife. Applicant is 19 years old boy, having no antecedents. Considering these facts, possibility of falsely involving the applicant in this case cannot be ruled out.

O R D E R

I.

Application is allowed.

II.

In the event of arrest, applicant be enlarged on bail in C.R. No.

37 of 2025 registered with Mahatma Gandhi Chowk Police Station, District: Sangli on furnishing P.R. Bond in the sum of Rs. 20,000/- with one or two sureties in the like amount.

III.

The applicant shall attend the concerned police station as and when required.

IV.

The applicant shall not tamper with the evidence or attempt to influence or contact the complainant, witnesses or any person concerned with the case.

Application is disposed of in above terms.
