Upon taking telephonic instructions from the instructing Advocate Mr.Ashok S.Chavan, Mr.Pachundkar submits that the Petition has become infractuous as the main suit itself is decided on merits.

This petition is directed against the order dated 16/06/2007 passed by the learned Joint Civil Judge, Junior Division, Madha, below Exhibit 27 in Regular Civil Suit No. 265 of 2006. As the main suit itself is decided on merits, nothing survives in this Petition and the same is disposed of as infractuous. Rule is discharged.
