Heard learned counsel for the parties.

By this Civil Application, the applicants are seeking condonation of 35 days delay in filing First Appeal challenging the Judgment and award dated 02nd December 2014 passed by the Motor Accident Claims Tribunal, Satara in Motor Accident claim Petition No. 285 of 2013 dismissing the Claim Petition under Section 166 of the Motor Vehicles Act. 3.
Considering the submissions made by the learned counsel for the Applicant and the averments made in Civil Application, I am satisfied that Applicant has made out a case for allowing the Civil Application. 4.
Hence, the following order is passed:
a) Delay in filling First Appeal, is condoned.
b) Civil Application stands disposed of accordingly. No order as to costs.
