1] The petitioner which is a registered society under the provisions of Maharashtra Cooperative Societies Act, 1960 has challenged the impugned order dated 20th April 1998 passed by the respondent No.1, thereby allowing the application for relaxation of condition by rejection the objection of the petitioner for registration in respect of collection of 400 liters of milk daily and further directing to proceed accordingly. This Court after hearing both sides finally on 12th August 1998 and subsequently while admitting the petition on 17th December 1998 granted interim relief in terms of prayer clause
YBG wp415698 (c). That resulted into the stay of condition and so also the impugned order dated 20th April 1998.
2] This matter is called out from final hearing board. In view of the above stay granted by this court and as the same was pending the proceedings, by this time, all the parties must have acted upon and must have been proceeded further for registration of the society. 3] There is nothing on record to show that the order passed by this Court is challenged further. The same remains in tact till this date. Therefore, taking a over all view of the matter, by keeping all points open, I am inclined to dispose of the present petition as it is not possible to grant further relief in such matters and or to vacate the same. However, parties are at liberty to initiate proceedings in accordance with law. The petition is, therefore, accordingly disposed of. Rule is discharged with liberty. No costs. ( ANOOP V. MOHTA, J.)
