Mr. Joshi states that petitioner is present in Court and identifies him. Mr. Joshi states that since Max Life Insurance Co. Ltd., who is shown as respondent no.1, and respondent no.2 in the petition have paid a sum of Rs.56,92,328.77 by way of cheque to petitioner, petitioner be permitted to withdraw the petition with leave to approach the Court if the cheque is dishonored.

Ms. Prasad appearing for Max Life Insurance Co. Ltd. assures the Court on behalf of Max Life Insurance Co. Ltd. and the Board of Directors and the persons, who have signed the cheque, that the cheque will be honored on presentation. Statement accepted as undertaking to this Court.
