1.
With the consent of the learned counsel for the parties, heard finally.
2.
In this petition, which has been filed as Public Interest Litigation, the petitioner has assailed the validity of action of the respondents in allotting the land for construction of Telugu Language Development Library.
3.
Facts giving rise to filing of this PIL, briefly stated, are that as per the Draft Development Plan, land bearing TPS-1, Final Plot No. 22, Paccha Peth, admeasuring 1 H. 73 R., was reserved for the purposes of Library and for the purposes of
4-PIL-94-2021.doc Park for school. On an application being made by the respondent no.5 - the Telagu Bhasha Public Library Solapur, a Trust, the same was allotted to it for the purposes of construction of a Telugu Language Development Library. The petitioner, thereupon, has filed the instant PIL questioning the said allotment.
4.
Learned counsel for the petitioner submits that during the pendency of the instant PIL, a Draft Development Plan has been issued in the month of December, 2024 in which the plot in question is reserved as play-ground.
5.
The aforesaid submission is placed on record. 6.
Thus, in view of subsequent proposal for change in user of the plot in question, it is evident that as of now the plot cannot be utilized for the purposes of setting up of the Telugu Library. Therefore, the issue involved in the instant PIL is rendered academic. However, liberty is reserved to the petitioner as well as respondent no.5 to make any suggestions/objections to the Draft Development Plan, if so advised.
7.
With the aforesaid liberty, the PIL is disposed of. (SANDEEP V. MARNE, J.) (CHIEF JUSTICE)
