CIVIL APPLICATION NO. 3803 OF 2016 As the entire amount of compensation has been deposited, the execution of the impugned award shall remain stayed during pendency of the appeal. The civil application is disposed of. CIVIL APPLICATION NO. 1018 OF 2016 Heard the learned counsel and perused the impugned judgment. Considering the nature of evidence on record for the present, the claimants are permitted to withdraw the amount of Rs.15 lakhs without furnishing any surety. The claimants shall file an undertaking within a period of eight Shraddha Talekar PS 1/2

11.fa.427.2016.doc weeks from today stating therein that in case the appeal is allowed, the amount which is withdrawn will be re­deposited with interest at such rate the Court may direct. The balance amount shall remain invested in fixed deposit.

Needless to state that if the matter is settled between the parties, the amount withdrawn shall be taken into consideration. The civil application is disposed of.
