Heard. This application is preferred by original Respondent for condonation of 39 days delay in filing the first appeal challenging the judgment and award dated 06/03/2013 passed by the MACT Satara in MACP No.595/2010 directing the Applicant to pay sum of Rs.4,12,500/ to the Respondent original claimant towards compensation together with interest @ 8% p.a. 2.
The learned counsel for the Respondent vehemently opposed the present Civil Application. He submits that the Applicant has not shown sufficient cause for condonation of 39 days delay. Basavraj G Patil 1/2

Considering the submissions made by the learned counsel for the Applicant and the averments made in the Application, I am satisfied that the Applicant has made out a case for allowing the present Civil Application. Hence, the following order :
A) Civil Application is allowed in terms of prayer clause (a) which read thus:
"a) That the delay of about 39 days in filing these appeals be condoned."
B) The Applicant to pay cost of Rs.250/ to the Respondent.
C) Office is directed to place the appeal along with pending Civil Application on board for admission on 04/02/2015.
D) Civil Application stands disposed off accordingly.
