The Petitioner was appointed as Shikshan Sevak w.e.f. 15th June 2021 with the Respondent No.7 - High School run by the Respondent No.6 - Education Institute. A proposal was submitted by Respondent Nos. 6 and 7 for individual approval to the appointment of the Petitioner in the post of Shikshan Sevak. The proposal is dated 31st October 2023, which is not yet decided.

The learned AGP appearing for the Respondent Nos. 1 to 5 1 of

opposed the petition.

Having heard learned Counsel for the parties, we direct the Respondent No.5 - Education Officer (Secondary) to decide the proposal dated 31st October 2023 for individual approval of the appointment of the Petitioner in the post of Shikshan Sevak on its own merits within a period of 8 weeks from the date of the communication of this order. If there are any deficiencies in the proposal, the Education Officer shall inform the Management of the deficiencies and give an opportunity to cure the deficiencies within the time frame. In the event, the proposal is approved, the Deputy Director of Education to issue Shalarth ID to the Petitioner within a period of 8 weeks thereafter. 4.

It is made clear that as there was a ban regarding imposition of financial implications till 1st November 2022, the learned Counsel for the Petitioner, on instructions, undertakes that he will not claim any financial benefits till the period 1st November 2022 in case his proposal is approved. It is further made clear that the Education Officer shall not reject the proposal on the ground that the appointment is not made through Pavitra Portal, subject to the Management fulfilling all other requirements regarding the appointment of the Petitioner. 2 of
