Heard Mr.Anand S. Patil, learned counsel for the applicant. None is present on behalf of the respondent no.1. I find that on 15th February 2016 when the matter was on board and was called out, counsel for the respondent no.1 had appeared and had sought for time. Time was granted accordingly. However, today the counsel for the respondent no.1 is absent. Leave granted.

Application be treated as a Memo of Appeal and be numbered accordingly.

Appeal is admitted.

Issue notice to the respondents.

The respondent no.1 shall execute a personal bond in the sum of Rs.15,000/­ before the trial Court within a period of four weeks from the service of notice on him. Hearing of the Appeal is ordered to be expedited. Liberty to either of the parties to move the Court for getting the date for final hearing of the Appeal fixed, after receipt of Record and Proceedings with paper book.
