By an order passed today in Civil Application No.602 of 2014 the above Petition has been restored to file. By consent of the learned counsel for the Petitioners, the above Petition is taken up for hearing as to admission. The above Petition challenges the order passed by the Maharashtra State Consumer Redressal Commission, Mumbai dated 9th September 2010 dismissing the Appeal filed by the Petitioners before the said Commission. In view of the fact that an alternative efficacious remedy by way of filing appropriate proceedings before the National Consumer Redressal Commission is available to the Petitioners and having regard to the judgments of the Apex Court reported in (2012) 8 SCC 524 in the matter of Cicily Kallarackal v/s. Vehicle Factory and (2011) 14 SCC 337 in the matter of Nivedita Sharma v/s. Cellular Operators Association of India and ors, it is not necessary for lgc
wp7776.12 this Court to entertain the above Petition. By relegating the Petitioners to the said remedy before the National Consumer Redressal Commission, the above Petition is disposed of.
