Heard. By this petition under Article 226 of the Constitution of India the Petitioner seeks direction against the Respondent State to take action against the three Auditors viz. Shri Prakash Shankar Patil, Shri Bhanudas S. Suryavanshi and Smt. Sanjivani Bhanudas Suryavanshi, as contemplated in the letters dated 09.04.2018 and 08.05.2018 respectively (Exhibit- L and M to the petition).

In the present proceedings, the Respondent State has filed Affidavit-in-Reply dated 15.10.2018 of Mr. Shrinivas Ganpat Pandhare, District Special Auditor, Class-II, Coop. Societies Basavraj G. Patil 1/2

11.11680.18-wp.doc (ADF), Kolhapur, affidavit dated 17.10.2018 of Lalitkumar Bhalchandra Bhavsar, Special Auditor, Cooperative Societies, Class-II, Maharashtra State, Pune and affidavit dated 25.10.2018 of Dr. Gajendra Abasaheb Deshmukh, Assistant Registrar for Cooperative Societies (Dairy), Kolhapur stating that they have already started taking action against those three Auditors. During the course of argument, the learned AGP, after taking instructions from their officers, who are present in court, makes a statement that they will complete the procedure for taking action within four months from today. The statement is accepted.

In view of the said statement of the learned AGP and the aforesaid affidavits, we do not find any substance in the Writ Petition. Same stands disposed of. No order as to costs. (N. J. JAMADAR, J.) (K. K. TATED, J.) Basavraj G. Patil 2/2
