Heard learned counsel for the Petitioner and learned A.G.P. for the Respondents-State.

We are of the opinion that the impugned order dated 2nd September 2022, which is at page 62 of the paper-book, could be treated as 'Show cause notice' to the Petitioners-Management for enabling them an opportunity to cure the deficiencies. Ordered accordingly. 3.

Accordingly, the Petitioners to cure the deficiencies as mentioned in osk 1 of

6-20-Wp-14043-2023.doc the show cause notice dated 2nd September 2022, within a period of two weeks from today.

After curing the deficiencies / considering the explanation of the Petitioners-Management, the Respondent No.5-Education Officer (Secondary) to decide the show cause notice within a period of 10 weeks from today.

If there are any further deficiencies noticed, the Respondent No.5Education Officer (Secondary) to give reasonable opportunity to the Petitioners-Management to cure the deficiencies. 6.

In case the approval to the appointment of the Petitioner No.3 is granted, the Respondent No.4 - Deputy Director is directed to enter the name of the Petitioner No.3 in Shalarth Pranali and issue Shalarth I.D. to the Petitioner No.3 and release the grant-in-aid towards payment of monthly salary / honorarium to the Petitioner No.3 since the date of his appointment with consequential benefits within a period of eight weeks from the date of grant of approval to the appointment of the Petitioner. 7.

Petition is disposed of in above terms.
